Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Fan League Sports, LLC ("Fan League," "we," "us," or "our"). They govern your use of the Fan League platform (the "Platform"), which includes all of our websites and all of our apps, including the fanleague.co website and Fan League Sports and Fan League Music, and any related services we provide (together, the "Services").

These Terms apply to the entire Platform: every Fan League site and every Fan League app. By using any part of the Platform, you agree to these Terms.

Please read these Terms carefully. They include limitations on our liability and affect your legal rights.

1. YOUR AGREEMENT TO THESE TERMS

By signing up for Fan League, by creating and maintaining an account, and by downloading, installing, accessing or using the app or any other part of the Services, you agree to be bound by these Terms and by our Privacy Policy. Your agreement is ongoing: it applies each time you use the Services and for as long as your account remains open, regardless of whether you have purchased a subscription or are using the Services for free at no monetary cost.

If you do not agree to these Terms, do not create an account and do not use the Services. If you are already using the Services and no longer agree, stop using them and close your account.

If you accept these Terms on behalf of a club, school, league or other organization, you confirm that you have authority to bind that organization, and "you" means that organization.

2. WHO MAY USE FAN LEAGUE

You may use the Services only if you can form a binding contract with us and are at least 13 years old. The Services are not directed to children under 13, and we do not knowingly permit anyone under 13 to create an account. If you are 13 or older but under the age of majority where you live, you may use the Services only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the Services.

Giving a false date of birth, or otherwise misrepresenting your age to gain access to or use the Services, is a breach of these Terms. Where we find that an account does not meet the age requirements above, we will terminate that account. No refund will be given for any subscription associated with it, whether currently active or paid for in the past. The data held for that account will be deleted, except that data already incorporated into aggregated or statistical form will not be deleted — in that case, any identifiers linking that data to you will be removed.

Fan League covers amateur sport, and profiles and statistics may relate to young athletes. If you add, edit or record information about another person, including a minor, you confirm that you are permitted to do so and that you have any consent required from that person or their parent or guardian.

3. YOUR ACCOUNT

  • You must provide accurate, current and complete information when you register, and keep it up to date.
  • You are responsible for all activity that takes place under your account.
  • You must keep your sign-in method secure. If you sign in with a passcode sent by email, or with a third-party account such as Google or Apple, you are responsible for keeping access to that email address or account secure.
  • You must tell us promptly at info@fanleague.co if you believe your account has been accessed without your permission.
  • You may not share your account with anyone else, or transfer it to anyone else, without our written consent.

4. BETA SERVICES

The Services are currently offered as a private beta. Beta Services are made available for evaluation, are provided "as is," and may be incomplete, may change substantially before general release, and may contain errors or defects. We may add, change, suspend or remove features at any time, and we may end the beta program at any time. You should not rely on Beta Services for any purpose where failure or inaccuracy would cause loss.

5. LICENSE TO USE THE APP

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to download and use one copy of the app on a device you own or control, and to use the Services for your own non-commercial use.

You may not, and may not permit anyone else to: copy, modify or create derivative works of the Services; reverse engineer, decompile or disassemble any part of the Services except to the extent that restriction is prohibited by law; rent, lease, sell, sublicense or otherwise transfer the Services; remove or obscure any proprietary notice; or use any automated means to access, scrape or extract data from the Services.

If you obtain the app through a third-party app store, your use is also subject to that store's terms. The app store provider is not a party to these Terms, has no obligation to provide support for the app, and is not responsible for any claim relating to the app.

6. ACCEPTABLE USE

You agree not to:

  • Use the Services in any way that breaks the law or infringes anyone else's rights.
  • Post or record content that is false, misleading, abusive, harassing, defamatory, obscene, hateful or that targets any person or group.
  • Impersonate any person or organization, or misrepresent your connection to a team, club, league or athlete.
  • Record scores, statistics or other game information that you know to be inaccurate, or tamper with records maintained by others.
  • Upload viruses or other harmful code, or interfere with, disrupt or place undue load on the Services or the networks they run on.
  • Attempt to gain unauthorized access to any part of the Services, to another user's account, or to any system or data.
  • Collect or harvest personal information about other users, including athletes and minors, other than through features we provide for that purpose.
  • Use the Services to send unsolicited commercial messages.

7. CONTENT YOU PROVIDE

"Your Content" means anything you submit, record or upload through the Services, including team and player details, schedules, scores, statistics, images and messages. You keep ownership of Your Content.

You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, publish and display Your Content, but only so far as needed to operate, provide, secure and improve the Services, and to make it visible to other users in the way the Services are designed to work. This license ends when Your Content is deleted, except for copies retained in backups or as required by law.

You are responsible for Your Content. You confirm that you have the rights needed to provide it and to grant the license above, and that it does not infringe anyone else's rights.

We do not routinely review Your Content, but we may remove or restrict access to content that we reasonably believe breaches these Terms or the law. If you believe content on the Services infringes your rights, contact us at info@fanleague.co.

8. GAME DATA AND STATISTICS

Scores, schedules, rosters, player details and statistics in the Services are recorded by users, not verified by us. We do not warrant that any of it is accurate, complete or current, and it is not an official record of any competition. Do not rely on it for selection, ranking, eligibility, wagering or any other decision of consequence.

9. PRIVACY AND YOUR DATA

We collect, use, store and disclose personal information in accordance with our Privacy Policy, which forms part of these Terms. The Privacy Policy explains what we collect, why we collect it, who we share it with, how long we keep it, and the rights and choices available to you.

By agreeing to these Terms, you acknowledge that your information will be handled as described in the Privacy Policy. If there is any inconsistency between these Terms and the Privacy Policy in relation to personal information, the Privacy Policy applies.

10. THIRD-PARTY SERVICES

The Services work alongside services we do not control, including sign-in providers, your device's share sheet and the social or messaging apps you share to, push notification services, email and SMS delivery providers, and app stores. Your use of those services is governed by their own terms and privacy policies. We are not responsible for them, and links or share options are not an endorsement.

11. FEES AND PAID PLANS

Fan League is free to use during the private beta. We may introduce paid plans or paid features in future. If we do, we will make the pricing and the terms that apply clear before you are asked to pay, and you will not be charged for anything without first agreeing to it. Any fees, billing periods, renewal and refund terms will be set out at the point of purchase and, where you buy through an app store, will also be subject to that store's terms.

12. OUR INTELLECTUAL PROPERTY

The Services, including the software, design, text, graphics, logos and the Fan League name and marks, are owned by us or our licensors and are protected by intellectual property laws. Except for the license in section 5, these Terms give you no rights in them. Feedback you send us about the Services may be used by us without obligation or payment to you.

13. SUSPENSION AND TERMINATION

You may stop using the Services and close your account at any time. See the Privacy Policy for how to request deletion of your data.

We may suspend or terminate your access, with or without notice, if you breach these Terms, if we reasonably believe your use puts other users or the Services at risk, or if we are required to do so by law. We may also discontinue the Services, in whole or in part, at any time.

Sections that by their nature should survive termination — including sections 7, 8, 12, 14, 15, 16 and 18 — continue to apply after your account is closed.

14. DISCLAIMERS

To the fullest extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy or uninterrupted or error-free operation.

We do not warrant that the Services will meet your requirements, that notifications will always be delivered or delivered on time, or that data will never be lost. Some jurisdictions do not allow the exclusion of certain warranties, and nothing in these Terms excludes or limits rights you have under consumer protection laws that cannot be excluded.

15. LIMITATION OF LIABILITY

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, goodwill, data or opportunity, arising out of or relating to your use of or inability to use the Services, whether based in contract, tort, negligence, strict liability or otherwise, and whether or not we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the Services will not exceed the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or USD $100.

16. INDEMNIFICATION

You agree to indemnify and hold harmless Fan League and its officers, employees and agents from any claim, demand, loss, liability, cost or expense, including reasonable legal fees, arising out of or relating to Your Content, your use of the Services, or your breach of these Terms or of any law or third-party right.

17. CHANGES TO THESE TERMS

We may update these Terms from time to time. If we make a material change, we will take reasonable steps to notify you, for example by posting a notice in the app or on this page, or by sending you a message. The "Last updated" date above shows when these Terms were last revised. Your continued use of the Services after a change takes effect means you accept the updated Terms.

18. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the State of Connecticut, United States, without regard to its conflict of laws rules, and you and we submit to the exclusive jurisdiction of the state and federal courts located in Connecticut. This does not deprive you of the protection of mandatory consumer laws of the country in which you live.

19. GENERAL

These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Services. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
